General payment policy and conditions at APNA ADVOCATS SPL.

Fees and Collections Legal Proceedings.

Fees for legal services will be determined based on the nature and complexity of the case, as well as the time and resources devoted by the firm.

After the initial consultation, the lawyer will prepare an estimate that will be valid for 15 calendar days. If accepted, payment will have to be made, depending on the form of payment chosen and detailed below.

The splitting of payments will be an exceptional situation that will be managed by the lawyer himself/herself and will be indicated in the same budget mail in case such splitting is possible.

Invoicing and Payment Methods:

The invoice corresponding to the payment will be sent to the e-mail indicated in the first consultancy. If you do not want to use this email for invoicing, you must indicate it in the email of the quotation.

The first form of payment will be by bank transfer to the bank account of the company APNA ADVOCATS SLP: ES92 2100 3674 2822 0001 5379, indicating concept followed by name and surname of the person interested in the process.

The second form of payment will be through the generation of a Payment Link, to be able to pay by electronic card. This link must be requested in the quotation email, if it has not already been sent in the same.

The third form of payment will be in cash at the same office located at Plaza Tetuán, 40-41 piso 1 oficina 21, 08010, Barcelona or by bank card payment at the same place.

Use of Legal Services:

Legal services will be provided in a professional, ethical and diligent manner, in accordance with the standards of the legal profession and the specific needs of the client.

Clients are expected to provide all necessary information and documentation in a timely manner to facilitate the progress of the case.

Cancellation of Services:

In the event that a client decides to cancel our services before the completion of the case, a cancellation fee will be applied to reflect the resources and time invested up to that point. For such a situation it will be assessed by the management of the law firm and the proposed cancellation fee will be sent to the client.

Refunds:

Partial or full refunds may be applied in exceptional situations, such as clerical errors by the firm or if legal services do not meet agreed standards. Refunds are subject to review and approval by the firm’s management.

Confidentiality and Privacy:

All communications and information shared between the client and the law firm will be treated in the strictest confidence, in accordance with applicable laws and the ethical standards of the legal profession.

This policy reflects our commitment to providing high quality legal services and transparency in our relationship with our clients. We are available to discuss any aspect of this policy and answer any questions you may have.

Unpaid installment payments.

If a date X is established for the installment payment, the reception department in charge of the deferred payments will make a call or send the corresponding message, being this a first warning, indicating the lack of payment and the immediate payment. If the payment is not made, the corresponding invoice is issued and must be paid within 10 calendar days at the latest and will be sent by the accounting department. If the stipulated time elapses and payment is not made, the law firm will initiate the actions it deems appropriate to recover its collection rights.

PAYMENT POLICIES AND CONDITIONS; REIMBURSEMENT AND CANCELLATION ON THE FIRST (SPECIFIC) CONSULTANCIES.

Payment of legal counsel.

The cost of legal advice at MC Abogados for the year 2024-2025 is 36.30€ VAT included if it is online and 48.40€ VAT included if it is in person. In order to reserve a day and time, prior payment must be made, in accordance with the payment methods stipulated in the General Conditions.

Confirmation of the reservation of the first legal advice.

Once the payment has been made, you will receive a confirmation by the means of communication that the law firm has active (email/ WhatsApp/ Phone call). Such confirmation will include date, time, location of the appointment, as well as other information of interest to the user.

Cancellation and reimbursement of the first legal advice.

If the user wishes to cancel the counseling, he/she must do so at least 24 hours before the assigned appointment, and the balance paid will be returned in the same way the payment was made. In case of impossibility, it will be returned in cash at the office located at Pl. Tetuán 40-41, 1st floor, office 21.

If the user does not cancel the consultation within 24 hours prior to its assignment, I will not be entitled to a refund, but will be entitled to a rescheduling within a maximum of 15 calendar days, according to the agenda of the law firm, being able to use any form of advice (virtual, face-to-face or video call), if not possible within the period, the advice already consigned will not be refundable.

If the user confirms his/her attendance to the first virtual counseling, but does not show up or does not connect online to it, the counseling will be cancelled within 15 minutes after the agreed time, and he/she will not be entitled to a refund and will have to pay for a new counseling.

Changes of first advice by the law firm.

The law firm may make changes in the reservation of first visits, within 48 hours, informing the user for its reorganization, so it will be attended with priority in accordance with the user’s agenda, and the rescheduled advice may be virtual / face-to-face or by phone call to expedite the service. The user will be entitled to a refund in case he/she does not want to take the advice on the day and date assigned by the law firm and will be returned, based on the above.

Acceptance of the General and Specific Conditions.

Upon payment of the first consultation, the client accepts the specific and general conditions of the law firm. And confirms that he/she has read and agrees with them.

POLICIES AND CONDITIONS OF VALIDITY OF GENERAL BUDGETS.

Introduction.

This policy establishes the conditions and terms under which the quotations issued by Martínez Caballero Abogados will be considered valid. It is designed to provide clarity and transparency for both our clients and the firm’s staff.

Validity of the Budget.

2.1. All quotations issued by [Martínez Caballero Abogados are valid for 15 calendar days from the date of issue.

2.2. The validity of the quotation will remain unchanged if the customer makes the corresponding payment within this period of 15 calendar days.

3. Retroactivity of Budgets.

3.1. Budgets may be backdated up to a maximum of 3 months prior to the date of issuance, provided that the following conditions are met:

a) The client must present documentary evidence justifying the request for retroactivity.

b) The request for retroactivity must be approved by a partner or manager of the firm.

c) The amount and conditions of the retroactive budget shall be subject to review and possible adjustment according to the services actually rendered during the period in question.

4. Validation Procedure.

4.1. For the validation of the quotation, the customer must:

a) Confirm your acceptance in writing (e-mail or physical signature) within the validity period of 15 calendar days.

b) Make the corresponding payment within the validity period to ensure the budget fixation. According to the payment conditions established in the company’s General Policy.

4.2. If the customer does not confirm acceptance or make payment within the validity period, the quotation issued will be considered null and void and a new quotation must be requested.

5. Review and Adjustments.

5.1. Martínez Caballero Abogados reserves the right to review and adjust the quotations issued based on changes in market conditions, associated costs or any other relevant variable.

5.2. Any adjustment will be duly communicated to the customer in advance and before the final confirmation of the quotation.

6. Acceptance of the Policy.

6.1. By requesting a quotation and/or accepting the services of Martínez Caballero Abogados the client accepts and agrees to comply with the terms set forth in this quotation validity policy.
