Constitute a common-law partnership without a notary

Welcome back to our blog, today we will be talking about two ways to establish a common-law relationship without having to go to a notary, but before the registry of stable couples in Catalonia. In our blog last week you can see the way of constituting it before a notary.

  • CONSTITUTE A DOMESTIC PARTNER BEFORE REGISTRATION FOR CONTINUOUS COEXISTENCE FOR TWO YEARS IN A ROW.

If you have been living with your partner at the same address for a period of two years in a row, you can constitute your common-law partner without having to go to a notary, and requesting a prior appointment with the registry of stable couples of Catalonia or doing it digitally if one of both people have a digital certificate.

If you register your common-law partner for two continuous years, you must bring with you or provide electronically the following documentation:

  • Identity document of the two people (DNI, NIE, Passport)
  • Birth certificate of the two people (Birth certificates of the foreigner legalized or apostilled).
  • Certificate of historical registration of coexistence (Original and updated certificate not to be more than 3 months old)

With these documents you can go to the stable couples registry office of Catalonia and deliver your documents. Remember that you must always carry a form that you can find on the official website of the Generalitat.

  • CONSTITUTE A DOMESTIC PARTNER BEFORE REGISTRY FOR HAVING OFFSPRING IN COMMON DURING THE COEXISTENCE.

If during the cohabitation with your partner you have had a child in common, you can constitute your common-law partner without having to go to a notary or even for two continuous years.

If you register your common-law partner by common descent during cohabitation, you must bring with you or provide electronically the following documentation:

  • Identity document of the two people (DNI, NIE, Passport)
  • Birth certificate of the two people (Birth certificates of the foreigner legalized or apostilled).
  • Certificate of historical registration of coexistence (Original and updated certificate not to be more than 3 months old)
  • Literal birth certificate or family book stating the descendants in common in case of constitution of the stable couple due to the birth of a son or daughter during cohabitation in a community of life analogous to marriage.

Advice: If there is no express opposition, the Department of Justice will automatically verify the data declared and documents 1, 3 and 4 will not have to be provided.

Then the de facto partnership registration resolution will arrive directly at your home.
