Labor Inspectorate in 2026
The Labor and Social Security Inspectorate will intensify its controls in various key areas of companies during 2026. Key focus areas will include time registration, equality plans, psychosocial risks, the use of algorithms in the workplace, and the fight against the informal economy.
For many companies, having correctly prepared labor documentation can make the difference between passing an inspection without issues or facing significant penalties.
One of the aspects that will remain a priority is the control of time registration and overtime. The Inspectorate will verify that companies correctly record working hours and that these records reflect the actual working day of employees.
Control over equality plans, which are mandatory for companies with 50 or more employees, will also be strengthened. It will not be enough to merely have the plan registered; companies will be required to demonstrate that the planned measures are actually being implemented.
Another point that will gain relevance is the assessment of psychosocial risks, especially given the increase in sick leave due to stress or mental health issues. All companies are obliged to carry out this assessment.
Furthermore, the Inspectorate will pay attention to the use of algorithms or artificial intelligence tools that may influence worker management or selection processes, with the aim of detecting potential discrimination.
Finally, campaigns against the informal economy, bogus self-employment, and the fraudulent use of certain employment contracts will continue.
Given this scenario, it is advisable for companies to review their labor situation and ensure compliance with regulations to avoid penalties.
