Unfair Traffic and Tax Fines in Barcelona: Objections, Appeals, and Comprehensive Defense

We defend clients against unfair traffic tickets and tax penalties in Barcelona.

Why should you trust MC Abogados to defend you against penalties in Barcelona?

Have you received a traffic fine or a tax penalty and disagree with it? At Martínez Caballero Abogados, we review your case, identify any errors in notification, substance, or procedure, and help you decide on the best strategy: appeal , request a stay , or, if fighting it isn’t worthwhile, protect yourself financially through the most reasonable means. In traffic matters, the DGT (Spanish Directorate General of Traffic) makes it clear that paying with a discount and appealing are incompatible paths; in tax matters, the AEAT (Spanish Tax Agency) focuses its defense on appeals, reconsideration, and economic-administrative claims.

Initial feasibility review before filing an appeal

Monitoring Deadlines to Avoid Losing Rights

Strategy: Statements of Objection, Appeal, or Complaint

What exactly do we do?

Traffic Fines

We review citations issued by the DGT or other traffic agencies: speeding, traffic light violations, parking violations, driver identification issues, loss of points, defective notices, or improperly handled citation procedures. The DGT allows you to file a statement of defense or an appeal and expressly states that if you pay during the voluntary payment period with a discount, any subsequent appeal will be deemed invalid.

Tax Penalties

We provide defense against tax assessments, tax penalties, demands for payment, proposed penalties, and decisions issued by the AEAT. The Tax Agency conducts its reviews through appeals for reconsideration, economic-administrative claims, and other review and suspension procedures.

Fines: What You Need to Know Before Paying or Appealing

The DGT states that if you receive a traffic ticket, you have an initial period of 20 calendar days to choose between:

  • Pay 50% of the amount due to close the case, or
  • File a claim or appeal, thereby forfeiting the discount.

If you let that initial deadline pass without paying or filing an appeal, the fine enters the standard procedure, and the DGT states that you have 45 days from the date of notification to pay 100% of the fine.

Errors in Traffic Tickets That May Justify an Appeal

Invalid notification

The DGT explains that notices may be sent by regular mail, via DEV, or posted on the TEU if you cannot be located. If there are issues with the method of notification, a defense may be filed.

Errors in identification or in the facts

When the case file is not well-substantiated or contains inconsistencies, it may be possible to file a motion.

Point deductions and related penalties

The DGT links traffic violations to its point system and to specific procedures for identification, filing a claim, and appealing.

Tax Penalties: Most Common Defenses

The AEAT focuses its audit procedures on several avenues, but the most common ones for individuals and businesses facing penalties are:

Statements and Responses to Requests

The AEAT headquarters allows you to respond to requests, file statements, and submit documentation in various proceedings.

Motion for Reconsideration

It is optional and must be filed with the same agency that issued the decision. The AEAT clarifies that if you file an appeal, you cannot file an economic-administrative complaint until the appeal is resolved either expressly or by default.

Economic-Administrative Appeal

This is the standard procedure for challenging administrative actions, audits, tax collection, and tax penalties. It can be filed online, at AEAT offices, post offices, and other authorized filing locations.

Debt Suspension and Management

When appealing a penalty or debt, it may be necessary to consider whether it is advisable to request a suspension, deferral, or payment plan. The AEAT has specific procedures in place for this purpose.

Tax Penalty Reductions: Think Twice Before Appealing

The reform, as explained by the AEAT itself in its FAQs on Law 11/2021, increased the reduction for early payment and failure to file an appeal or claim from 25% to 40%. This makes it especially important to analyze each case before filing an appeal, because in some cases it may be more advantageous to accept the reduction and close the proceedings, while in others it may be better to challenge the penalty.

How We Handle Your Case

1. Initial review of the case file

We assess whether there are errors in substance, form, notification, or calculation, and whether it makes financial sense to appeal.

2. Strategy

We suggest the right approach:

  • For traffic violations: pay the reduced fine or file a claim/appeal.
  • With the Tax Authority: appeals, requests for reconsideration, economic-administrative claims, or debt management.

3. Presentation and Follow-up

We draft the brief, present the defense, and monitor the case until a decision is reached.

4. Subsequent phase

If necessary, we explore new avenues: enforcement, suspension, subsequent claims, or litigation, depending on the case.

Why Choose Martínez Caballero Abogados

Many competitors in this field focus their pitch on “we appeal all fines” or on high success rates. In tax matters, others market their expertise in inspections, penalties, and claims against the tax authorities. Our approach combines the best of both worlds: a thorough legal review, strategic decision-making before taking action, and a clear explanation of whether or not it’s worth appealing. This approach is more credible and more helpful to the client.

Frequently Asked Questions About Unemployment Benefits Accrual

Unemployment benefit capitalization, also known as a lump-sum payment of unemployment benefits, allows you to receive the outstanding amount of your contributory unemployment benefits in a single payment to use toward starting a self-employed business, joining a cooperative or worker-owned company, or financing your new business.

To be able to receive unemployment benefits, you must:

  • To be receiving or to be entitled to a contributory unemployment benefit.

  • You must have at least three months of unemployment benefits remaining to be paid when you submit your application.

  • You must not have requested capitalization in the past 4 years.

  • The activity for which the lump-sum payment is requested must not have begun before the application was submitted.

  • Not be registered with Social Security at the time of application.

The common requirements are:

  • Be a recipient of contributory unemployment benefits.

  • There must be at least three monthly payments remaining to be collected.

  • Submit the application before starting your business or registering as a self-employed individual.

  • Not having received another lump-sum payment in the past 4 years.

  • Prepare an explanatory report or project plan if you intend to use the funds for an investment.

You can use the one-time payment to:

  • Initial business investment (equipment, materials, renovations, etc.).

  • Payment of self-employed social security contributions (as a monthly subsidy if you choose that option).

  • Contribution of capital to join or form a corporation or cooperative.

  • Expenses directly related to the project’s launch.

No. To apply for the lump-sum payment, you must be legally unemployed—that is, without a job and not enrolled in Social Security—and have been approved for contributory benefits. If you are working, even part-time, you are not eligible to apply.

Once the capitalization has been approved, you must begin your business as a self-employed individual or partner within one month of the favorable decision and provide proof that the funds received have been invested in the project.

If you cease the activity you funded with the lump-sum payment before the minimum period has elapsed (generally 5 years, according to regulations and standard practice), the government may require you to repay all or part of the amount received.

Yes. If you are joining an existing cooperative or worker-owned company as a working member, you can apply for capitalization if you meet the requirements, including member status and a contribution of capital stock.

Once the application has been submitted correctly, SEPE typically issues a decision within about 15 days, and if the decision is favorable, payment is usually made on the 10th of the month following notification of approval.

Standard documentation includes:

  • Official single payment application form.

  • ID card/NIE/passport.

  • Proof of unemployment status and approved benefits.

  • Explanatory report on the project or business plan.

  • Supporting documentation and investment budgets, if applicable.

You can request it:

  • Online through the SEPE’s Electronic Portal using a digital certificate or Cl@ve.

  • In person at the SEPE office by appointment.

  • At any public registry office or by administrative mail.

The lump-sum payment is exempt from personal income tax if you use the funds for their intended purposes and continue the business for the required number of years. If you stop the business before the minimum period is up, you may have to pay taxes.
