What is marriage registration in Spain, and what is its purpose?

Registration is the official record that documents the marriage in the Spanish Civil Registry. It serves to verify your marital status in Spain and to request official certificates (full certificate/extract), which are required for many administrative procedures.

Important: The Ministry of Justice reminds the public that Civil Registry services and certificates are free of charge, and warns against private websites that charge for “processing certificates” when these are not official fees.

Which Civil Registry has jurisdiction in each case?

If the marriage took place in Spain

Registration is carried out at the appropriate Civil Registry (depending on the location of the event or the registry’s jurisdiction).

If the marriage took place abroad

Registration may be initiated based on the “principle of proximity” at the Civil Registry office corresponding to the individual’s place of residence or at the Central Civil Registry, and may require additional procedures or transfers depending on the case.

Practical note: For “marriages solemnized outside of Spain,” it is usually required that at least one of the spouses be a Spanish citizen at the time the application is filed (according to the Ministry’s informational brochure).

Cases We Typically Help With (the Most Common Ones)

  • Marriage performed abroad and you need a transcript in Spain

  • Marriage to a Foreign Spouse for an EU Family Member Card / Residency

  • Do you need a certified copy of your Spanish marriage certificate for citizenship or other procedures?

  • There was a previous divorce or widowhood, and the documentation must be organized correctly

  • The Registry requests an interview or proof of the relationship (a “complete and consistent” file)

How We Process Your Registration (Step by Step)

1) Diagnosis and “risk screening”

We’ll confirm where you should start the process (local RC / RCC), which documents are missing, and which ones need to be apostilled or translated.

2) Preparation of the case file

We organize the documentation, identify common inconsistencies (dates, previous marital status, first and last names, invalid certificates), and prepare the file for submission.

3) Presentation and Follow-up

We submit applications and follow up on them until they are resolved or registered and a certification request is made.

4) Delivery of Results

We’ll help you obtain a certified copy of your marriage certificate for your future paperwork.

Standard Documentation Required to Register a Marriage Performed Outside of Spain (Official Checklist)

The authorities may request additional documentation depending on the country and the specific case, but generally, the official form from the Central Civil Registry includes:

Marriage Documents

  • Certified/original foreign marriage certificate, with a translation if necessary and legalization or an apostille (Hague Convention, when applicable).

  • If the certificate does not indicate the previous marital status, please provide a supporting document that verifies it.

Personal Documents

  • Full birth certificates: for the Spanish spouse (from the Spanish Civil Registry) and for the foreign spouse (apostilled/legalized).

  • Identification: National ID card (DNI) or other Spanish identification document for the Spanish spouse, and identification document for the foreign spouse.

  • Group registration and documents proving a permanent address in Spain.

  • Completed data declaration form + contact information (phone number/email).

Whether there was a previous marriage, divorce, or widowhood

  • Certificate of a previous marriage that has been dissolved (by divorce or death) and, if applicable, a final judgment or document that has been duly translated and apostilled or legalized.

  • Death certificate (if widowed), when applicable.

If there are children

Birth certificates for children (whether from the same or different relationships) or a family register, or an equivalent document, as applicable.

If it was a marriage by proxy

Copy of the power of attorney (if applicable).

Is there an interview? What is a “private hearing” and how can you prepare for it?

In certain cases, a private hearing or separate interview may be required to verify the authenticity of the relationship. We’ll prepare you with a list of typical questions and a package of recommended evidence (photos, travel records, residency registration, correspondence, etc.) to avoid any contradictions.

Estimated deadlines

Processing times depend on the relevant office, its workload, and whether there are any additional requirements or an interview. Our goal is to reduce processing times by avoiding errors from the start (incomplete or improperly legalized documentation is usually what causes the greatest delays).

Frequently Asked Questions About Marriage Registration in Barcelona

This is the process by which a marriage—especially one that took place abroad—is officially registered with the Spanish Civil Registry. Once registered, the marriage has full legal effect in Spain.

Yes, if you want your marriage to be legally recognized in Spain and to be able to obtain a full Spanish marriage certificate for purposes such as residency, citizenship, inheritance, or administrative procedures.

If the marriage took place outside of Spain, the process can be initiated at the Civil Registry office corresponding to the couple’s place of residence in Spain or at the Central Civil Registry, depending on the circumstances and the spouses’ nationalities.

Generally, the following are required: a certified copy of the foreign marriage certificate (apostilled or legalized and, if applicable, translated), the spouses’ birth certificates, identity documents, and proof of residency. In specific cases, additional documents may be required.

Yes, unless there is an international agreement that exempts the document from legalization. For most marriages performed outside of Spain, a Hague Apostille or consular legalization is required.

If the marriage certificate or any other document is written in a language other than Spanish, an official certified translation must be provided.

Yes. In some cases, especially when one of the spouses is a foreign national, the Registry may schedule a private hearing to verify the authenticity of the marriage.

The processing time varies depending on the relevant Civil Registry office and its workload. It may take several months, especially if additional documents or an interview are required.

No. Civil Registry services and the issuance of certificates are free of charge. Any fees paid, if applicable, are for professional services related to processing and consultation.

You must provide documentation proving the dissolution of the previous marriage (divorce or death), duly legalized and translated if necessary.

Depending on the relevant registry, part of the process can be handled online, but in some cases it will be necessary to submit original documents or attend an in-person appointment.

Because a missing document, an error in the legalization process, or an inconsistency in the information can lead to requests for additional documentation and significant delays. A file that is well-prepared from the start reduces processing time and increases the likelihood of successful registration without issues.
