Principaux d\u00e9veloppements et r\u00e8gles cl\u00e9s<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Changement libre apr\u00e8s trois mois : apr\u00e8s trois mois \u00e0 compter de l&rsquo;octroi de l&rsquo;autorisation, l&rsquo;\u00e9tranger peut changer d&#8217;employeur sans avoir \u00e0 en justifier la raison ni \u00e0 en informer l&rsquo;Office des \u00e9trangers.<br\/><\/li>\n\n\n\n<li>Changement avant trois mois pour une raison justifi\u00e9e : dans des situations telles que lorsque la demande est toujours en cours, lorsque l&rsquo;autorisation a \u00e9t\u00e9 accord\u00e9e mais que l&rsquo;inscription \u00e0 la s\u00e9curit\u00e9 sociale n&rsquo;a pas eu lieu, ou lorsqu&rsquo;il y a une inscription et une d\u00e9sinscription imm\u00e9diates, le changement est autoris\u00e9. Mais il doit \u00eatre communiqu\u00e9 \u00e0 l&rsquo;Office des \u00e9trangers en m\u00eame temps que le nouveau contrat. <br\/><\/li>\n\n\n\n<li>D\u00e9lais de notification du changement :<br>\n<ul class=\"wp-block-list\">\n<li>G\u00e9n\u00e9ralit\u00e9s : deux mois apr\u00e8s que la n\u00e9cessit\u00e9 d&rsquo;un changement est connue.<br\/><\/li>\n\n\n\n<li>S&rsquo;il n&rsquo;y a pas d&rsquo;inscription \u00e0 la s\u00e9curit\u00e9 sociale apr\u00e8s l&rsquo;attribution : d\u00e9lai r\u00e9duit \u00e0 un mois<br\/><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Exigences du nouveau contrat : doit satisfaire aux exigences minimales du RLOEX : au moins une partie proportionnelle du salaire minimum interprofessionnel, un temps de travail minimum de 20 heures par semaine (peut \u00eatre atteint avec un ou plusieurs contrats).<br\/><\/li>\n\n\n\n<li>Applicable \u00e9galement pendant les recours : si le changement intervient pendant le traitement d&rsquo;un recours, le demandeur dispose de deux mois pour le communiquer et son autorisation est maintenue tant qu&rsquo;il s&rsquo;inscrit \u00e0 la s\u00e9curit\u00e9 sociale au cours du mois suivant.<br\/><\/li>\n\n\n\n<li>Racines sociales ant\u00e9rieures : le crit\u00e8re est \u00e9galement \u00e9tendu aux personnes qui ont obtenu la r\u00e9sidence en raison de racines sociales conform\u00e9ment au r\u00e8glement pr\u00e9c\u00e9dent (RD 557\/2011), en respectant toujours les exigences en vigueur \u00e0 l&rsquo;\u00e9poque.<br\/><\/li>\n<\/ul>\n\n<p><strong>3) Pourquoi ce crit\u00e8re est-il important ?<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Une plus grande s\u00e9curit\u00e9 juridique : Les demandeurs peuvent changer d&#8217;emploi sans craindre de perdre leur autorisation.<br\/><\/li>\n\n\n\n<li>Flexibilit\u00e9 face \u00e0 des circonstances impr\u00e9vues : Prot\u00e8ge les personnes confront\u00e9es \u00e0 des situations professionnelles impr\u00e9vues qui les emp\u00eachent de continuer \u00e0 travailler pour leur employeur initial.<br\/><\/li>\n\n\n\n<li>Clart\u00e9 pour les organismes officiels : \u00e9vite les interpr\u00e9tations divergentes entre les bureaux des \u00e9trangers.<br\/><\/li>\n\n\n\n<li>Stabilit\u00e9 pendant les proc\u00e9dures administratives : garantit un statut juridique m\u00eame pendant les recours administratifs.<br\/><\/li>\n<\/ul>\n\n<p><strong>4.
