Pour \u00eatre qualifi\u00e9 d&rsquo;abusif, le licenciement doit \u00eatre contest\u00e9 devant les tribunaux du travail.<\/div>\n<div> <\/div>\n<div><strong>Dans quelles circonstances consid\u00e9rons-nous un licenciement abusif ?<\/strong><\/div>\n<div> <\/div>\n<ul>\n<li>L&#8217;employeur ne prouve pas, dans la lettre de licenciement, les raisons du licenciement.<\/li>\n<li>L&#8217;employeur ne respecte pas les formalit\u00e9s requises par la loi ou les conventions collectives.<\/li>\n<li>En cas de licenciement d&rsquo;un salari\u00e9 membre d&rsquo;un syndicat, l&#8217;employeur omet la proc\u00e9dure d&rsquo;audition des d\u00e9l\u00e9gu\u00e9s syndicaux ou la proc\u00e9dure du dossier contradictoire en cas de licenciement d&rsquo;un repr\u00e9sentant du personnel.<\/li>\n<\/ul>\n<div><strong>Si le licenciement est consid\u00e9r\u00e9 comme abusif, que se passe-t-il ensuite ?  <\/strong><\/div>\n<div> <\/div>\n<div>Si le licenciement est d\u00e9clar\u00e9 injustifi\u00e9, le jugement ordonne \u00e0 l&rsquo;entreprise d&rsquo;opter, dans les cinq jours de la notification du jugement, pour :<\/div>\n<div> <\/div>\n<ul>\n<li>R\u00e9int\u00e9grer le travailleur en lui versant les salaires qu&rsquo;il n&rsquo;a pas per\u00e7us depuis la date du licenciement jug\u00e9 abusif.<\/li>\n<li>Compenser le travailleur sur la base du nombre de jours de salaire par ann\u00e9e travaill\u00e9e.<\/li>\n<\/ul>\n<div> <\/div>\n<div>La propri\u00e9t\u00e9 de l&rsquo;option est g\u00e9n\u00e9ralement d\u00e9volue \u00e0 l&#8217;employeur, bien qu&rsquo;elle puisse \u00e9galement \u00eatre d\u00e9volue au travailleur licenci\u00e9 lorsqu&rsquo;il est un repr\u00e9sentant unitaire ou syndical des travailleurs.<\/div>\n<div> <\/div>\n<div><strong>Que recommandons-nous, chez Mart\u00ednez Caballero Abogados ?  <\/strong><\/div>\n<div> <\/div>\n<ul>\n<li>Si, en tant que salari\u00e9, vous avez \u00e9t\u00e9 licenci\u00e9 et que vous consid\u00e9rez qu&rsquo;il n&rsquo;y a pas de motifs pour le justifier, lorsque vous devez signer la notification de licenciement, une mention \u00ab\u00a0non conforme\u00a0\u00bb doit figurer \u00e0 c\u00f4t\u00e9 de votre signature.
