Waiver of exams to obtain Spanish nationality
<\/strong><\/h4>
<\/div>

Since the reform of the procedure for Spanish nationality by residence, many people who wish to apply for it have doubts about the tests they must take to prove their integration in Spain. One of the most frequent questions we receive in our office is whether there is the possibility of obtaining Spanish nationality without having to take the mandatory exams, especially in those cases in which the applicant has difficulties to pass them. <\/p>

The current procedure for obtaining Spanish nationality by residence was regulated with the approval of the Royal Decree 1004\/2015<\/span><\/span>. From this rule it was established, as a general rule, that persons wishing to apply for Spanish nationality must prove their degree of integration into Spanish society by passing certain official tests. <\/p>

Specifically, two main examinations were established. On the one hand, the test of constitutional and sociocultural knowledge of Spain (CCSE), which evaluates basic knowledge of the Constitution, the organization of the State and fundamental aspects of Spanish society. On the other hand, the test of knowledge of the Spanish language (DELE), which certifies a minimum level of comprehension and expression in the Spanish language. Both tests are administered by the Cervantes Institute<\/span><\/span>. <\/p>

However, the regulations contemplate certain situations in which it is possible to request a waiver of these tests. The waiver is an exceptional authorization that allows the applicant to process his or her nationality file without the need to take one or both exams, when there are personal circumstances that justify it. <\/p>

This possibility is provided for in the regulations governing the nationality procedure and applications are decided by the Ministry of Justice. Ministry of Justice<\/span><\/span>through the General Directorate of Legal Security and Public Faith.<\/span><\/span>.<\/p>

Among the cases in which dispensation may be requested are, for example, people who cannot read or write, those who have learning difficulties or significant educational limitations, as well as certain cases in which personal or social circumstances make it difficult to take the tests.<\/p>

Likewise, administrative practice also takes into account the cases of persons who have completed official studies in Spain. In many cases, those who have completed Compulsory Secondary Education (ESO), vocational training, baccalaureate or university studies in Spain can prove their integration by providing the corresponding academic degree, which may allow the possibility of a waiver to be considered or that it is not necessary to take certain tests. <\/p>

Minors and persons with disabilities or with limitations that prevent them from performing the examinations under normal conditions may also benefit from this possibility.<\/p>

It is important to note that the waiver is not granted automatically. Each application is analyzed individually by the Administration, which may request additional documentation to accredit the alleged circumstances. For this reason, it is essential to prepare the application correctly and to provide all the necessary documents that justify the applicant’s personal situation. <\/p>

In many cases, the waiver can be an important way for certain persons to gain access to the Spanish nationality procedure when, due to their personal circumstances, they cannot pass the generally required exams.<\/p>

Therefore, before initiating the Spanish nationality procedure, it is advisable to analyze each specific case to assess whether it is appropriate to request a waiver and what is the best strategy to process the file correctly.<\/p><\/div>
