We explain what constitutes a criminal injury, the different types of injuries, and how they are punished. <\/p>\n\n<p><strong>What is a crime of bodily injury?<\/strong><\/p>\n\n<p>It is governed by Articles 147 through 156-ter of the Penal Code. It occurs when one person causes another person harm that requires medical or surgical treatment beyond simple care. <\/p>\n\n<p>Requirements for an Act to Constitute a Crime<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Bodily injury, whether physical or mental.<\/li>\n\n\n\n<li>The need for medical treatment (a cure alone is not enough).<\/li>\n\n\n\n<li>A clear causal link between the action and the harm.<\/li>\n\n\n\n<li>Existence of willful misconduct or negligence.<\/li>\n<\/ul>\n\n<p><strong>Types of Offenses Under the Penal Code<\/strong><\/p>\n\n<p><strong>1. Basic injuries (Art. 147.1):<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>They require medical treatment.<\/li>\n\n\n\n<li>Penalty: 3 months to 3 years in prison or a fine equivalent to 6 to 12 months&#8217; wages.<\/li>\n<\/ul>\n\n<p><strong>2. Minor injuries and workplace abuse:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>They do not require medical treatment.<\/li>\n\n\n\n<li>Penalty: a fine of 1 to 3 months.<\/li>\n<\/ul>\n\n<p><strong>3. Aggravated injuries (Art. 148)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Use of a weapon, dangerous instrument, premeditation, cruelty, vulnerable victim.<\/li>\n\n\n\n<li>Penalty: 2 to 5 years in prison.<\/li>\n<\/ul>\n\n<p><strong>4. Injuries Caused by Negligence (Art. 152)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>E.g., workplace accidents, traffic accidents, or medical accidents.<\/li>\n\n\n\n<li>The penalty varies depending on the damage caused.<\/li>\n<\/ul>\n\n<p><strong>5. Mutilation or maiming (Articles 149\u2013150)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Loss of major organs (eyes, hands, etc.).<\/li>\n\n\n\n<li>Penalty: 6 to 12 years (principal offenses) or 3 to 6 years (non-principal offenses).<\/li>\n<\/ul>\n\n<p><strong>6.
