We explain what is considered criminal injury, what types exist and how they are punished. <\/p>\n\n<p><strong>What is a crime of injury?<\/strong><\/p>\n\n<p>It is regulated in articles 147 to 156 ter of the Penal Code. It occurs when a person causes harm to another person that requires medical or surgical treatment, beyond a simple cure. <\/p>\n\n<p>Requirements for it to be a crime<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Bodily, physical or mental harm.<\/li>\n\n\n\n<li>Need for medical treatment (a cure is not enough).<\/li>\n\n\n\n<li>Clear causal link between the action and the damage.<\/li>\n\n\n\n<li>Existence of malice or recklessness.<\/li>\n<\/ul>\n\n<p><strong>Types of injuries according to the Penal Code<\/strong><\/p>\n\n<p><strong>1. Basic injuries (art. 147.1):<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>They require medical treatment.<\/li>\n\n\n\n<li>Penalty: 3 months to 3 years imprisonment or a fine of 6 to 12 months.<\/li>\n<\/ul>\n\n<p><strong>2. Minor injuries and mistreatment of work:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>They do not require medical treatment.<\/li>\n\n\n\n<li>Penalty: fine of 1 to 3 months.<\/li>\n<\/ul>\n\n<p><strong>3. Aggravated injuries (art. 148)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Use of weapons, dangerous instrument, malice aforethought, overkill, vulnerable victim.<\/li>\n\n\n\n<li>Penalty: 2 to 5 years imprisonment.<\/li>\n<\/ul>\n\n<p><strong>4. Injuries due to recklessness (art. 152)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>E.g.: occupational, traffic or medical accidents.<\/li>\n\n\n\n<li>The penalty varies according to the damage caused.<\/li>\n<\/ul>\n\n<p><strong>5. Mutilations or disabling (art. 149-150)<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Loss of major organs (eyes, hands, etc.).<\/li>\n\n\n\n<li>Penalty: 6 to 12 years (principal organs) or 3 to 6 years (non-principal organs).<\/li>\n<\/ul>\n\n<p><strong>6. Gender or domestic violence<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Penalties are aggravated.<\/li>\n\n\n\n<li>The process can be initiated without a complaint.<\/li>\n<\/ul>\n\n<p><strong>Necessary tests<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Emergency medical report.<\/li>\n\n\n\n<li>Coroner&#8217;s report.<\/li>\n\n\n\n<li>Witnesses or recordings, if available.<\/li>\n<\/ul>\n\n<p><strong>Additional consequences<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Compensation to the victim.<\/li>\n\n\n\n<li>Restraining orders or removal of weapons.<\/li>\n\n\n\n<li>Criminal record even with agreement of conformity.<\/li>\n<\/ul>\n\n<p>Have you been denounced for injuries or have you been a victim?
