In Spain, certain behaviors are considered <strong>crimes against road safety<\/strong>, and can lead to <strong>prison sentences, withdrawal of your driver&#8217;s license and a criminal record.<\/strong> <\/p>\n\n<p>In this article we explain what are the most frequent crimes, the legal consequences and how you can defend yourself if you have been cited or arrested.<\/p>\n\n<p><strong>Fine or crime? Key differences <\/strong><\/p>\n\n<p>In Spain it is important to differentiate between an <strong>administrative infraction and a criminal offense:<\/strong><\/p>\n\n<p><strong>Administrative infraction:<\/strong><br\/>Sanction imposed by the <strong>DGT (Direcci\u00f3n General de Tr\u00e1fico).<\/strong> It involves economic fines, loss of points and temporary withdrawal of the driver&#8217;s license.<\/p>\n\n<p><strong>Crime against road safety:<\/strong><br\/>It is regulated in <strong>Title XVII of the Penal Code<\/strong>, articles 379 to 385 ter. It involves <strong>judicial proceedings, imprisonment or criminal fine<\/strong>, withdrawal of the driver&#8217;s license, criminal record and automatic loss of points. <\/p>\n\n<p>\u2139\ufe0f <strong>Update 2025:<\/strong> According to data from the Ministry of the Interior, more than 94,000 people were convicted of road offenses in 2024, with alcohol-related crimes being the most frequent (interior.gob.es).<\/p>\n\n<p>\ud83d\udeab <strong>Main offenses against road safety<\/strong>.<\/p>\n\n<p>These are the most common according to the Spanish Penal Code:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Serious speeding (Art. 379.1 PC)<\/strong><\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>Exceeding <strong>more than 60 km\/h on urban roads or more than 80 km\/h on interurban roads.<\/strong><\/li>\n\n\n\n<li><strong>Penalty:<\/strong> imprisonment of 3 to 6 months, or fine of 6 to 12 months, and withdrawal of license for 1 to 4 years.<\/li>\n<\/ul>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Driving under the influence of alcohol or drugs (Art. 379.2 PC)<\/strong><\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li><strong>Alcohol:<\/strong> more than <strong>0.60 mg\/l in exhaled air<\/strong> or <strong>1.2 g\/l in blood.<\/strong><\/li>\n\n\n\n<li><strong>Drugs:<\/strong> presence of psychotropic substances in the body.<\/li>\n\n\n\n<li><strong>Penalty:<\/strong> imprisonment from 3 to 6 months, or fine, community service, and withdrawal of driving license for up to 4 years.<\/li>\n<\/ul>\n\n<p>\u26a0\ufe0f The consumption of prescription drugs may also be punishable if it affects driving (dgt.es).<\/p>\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Refusal to submit to tests (Art. 383 PC)<\/strong><\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>Refuse breathalyzer or drug tests, even without having consumed.<\/li>\n\n\n\n<li><strong>Penalty:<\/strong> imprisonment from 6 months to 1 year and withdrawal of license for up to 4 years.<\/li>\n<\/ul>\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Reckless driving (Art. 380 and 381 PC)<\/strong><\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>Create real danger to other road users. Examples: <\/li>\n<\/ul>\n\n<p>&#8211; Driving in the wrong direction<br\/>&#8211; Illegal racing <br\/>&#8211; Repeatedly jumping traffic lights<br\/>&#8211; Fleeing from police controls<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Penalty:<\/strong> imprisonment from 6 months to 2 years and deprivation of the right to drive for up to 6 years.<\/li>\n<\/ul>\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Driving without a license (Art. 384 PC)<\/strong><\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>Never having obtained it, having it withdrawn by judgment or total loss of points.<\/li>\n\n\n\n<li><strong>Penalty:<\/strong> imprisonment of 3 to 6 months, or a fine of 12 to 24 months, or community service.<\/li>\n<\/ul>\n\n<p>\ud83e\uddfe <strong>Can the trial be avoided?<\/strong><\/p>\n\n<p>Yes, it is possible to reach a plea agreement. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Acknowledging the facts <strong>reduces the penalty by up to one third.<\/strong><\/li>\n\n\n\n<li>In exchange, the trial will be waived and a conformity judgment will be rendered.<\/li>\n\n\n\n<li><strong>Consequences:<\/strong> criminal record and automatic withdrawal of the driver&#8217;s license.<\/li>\n<\/ul>\n\n<p>\ud83d\udccc According to the State Attorney General&#8217;s Office, more than 70% of road safety offenses are resolved by agreement in the duty court or in a speedy trial.<\/p>\n\n<p>\u2696\ufe0f <strong>What to do if you have been arrested or subpoenaed?<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Ask for immediate legal assistance.<\/strong><br\/>You have the right to a lawyer from the first moment.
