Dazu m\u00fcssen wir die Artikel 3 und 4 des Gesetzes 12\/2009 vom 30. Oktober ber\u00fccksichtigen, das das Recht auf Asyl und subsidi\u00e4ren Schutz regelt. So:<\/h4>\n<p>Wie in Artikel 3 festgelegt, ist der Fl\u00fcchtlingsstatus: &#8222;Die Fl\u00fcchtlingseigenschaft wird jeder Person zuerkannt, die sich aus der begr\u00fcndeten Furcht vor Verfolgung wegen ihrer Rasse, Religion, Nationalit\u00e4t, politischen \u00dcberzeugung, Zugeh\u00f6rigkeit zu einer bestimmten sozialen Gruppe, ihres Geschlechts oder ihrer sexuellen Ausrichtung au\u00dferhalb des Landes befindet, dessen Staatsangeh\u00f6rigkeit sie besitzt, und den Schutz dieses Landes nicht in Anspruch nehmen kann oder wegen dieser Furcht nicht in Anspruch nehmen will, oder ein Staatenloser, der keine Staatsangeh\u00f6rigkeit besitzt und au\u00dferhalb des Landes seines fr\u00fcheren gew\u00f6hnlichen Aufenthalts aus denselben Gr\u00fcnden nicht dorthin zur\u00fcckkehren kann oder wegen dieser Furcht nicht dorthin zur\u00fcckkehren will und auf den keiner der Ausschlussgr\u00fcnde nach Artikel 8 oder der Gr\u00fcnde f\u00fcr die Verweigerung oder den Widerruf nach Artikel 9 zutrifft.<\/p>\n<p>Andererseits ist in Artikel 4 festgelegt, dass subsidi\u00e4rer Schutz gew\u00e4hrt wird: &#8222;Personen aus anderen L\u00e4ndern und Staatenlose, die zwar nicht die Voraussetzungen f\u00fcr die Zuerkennung der Fl\u00fcchtlingseigenschaft erf\u00fcllen, bei denen jedoch stichhaltige Gr\u00fcnde f\u00fcr die Annahme bestehen, dass sie bei einer R\u00fcckkehr in ihr Herkunftsland im Falle von Staatsangeh\u00f6rigen oder im Falle von Staatenlosen in das Land ihres vorherigen gew\u00f6hnlichen Aufenthalts tats\u00e4chlich Gefahr liefen, einen der in Artikel 10 dieses Gesetzes genannten ernsthaften Sch\u00e4den zu erleiden, und die nicht in ihr Herkunftsland oder in das Land ihres vorherigen gew\u00f6hnlichen Aufenthalts zur\u00fcckkehren k\u00f6nnen oder wegen dieser Gefahr nicht zur\u00fcckkehren k\u00f6nnen, tats\u00e4chlich Gefahr laufen, einen der in Artikel 10 dieses Gesetzes genannten schweren Sch\u00e4den zu erleiden, und die den Schutz des betreffenden Landes nicht in Anspruch nehmen k\u00f6nnen oder wegen dieser Gefahr nicht in Anspruch nehmen wollen, sofern keiner der in den Artikeln 11 und 12 dieses Gesetzes genannten Umst\u00e4nde vorliegt&#8220;.<\/p>\n<h5>BESONDERE F\u00c4LLE. VENEZOLANISCHE STAATSANGEH\u00d6RIGE, DEREN ANTR\u00c4GE AUF INTERNATIONALEN SCHUTZ ABGELEHNT WURDEN.<\/h5>\n<p>In Anbetracht der wirtschaftlichen, sozialen und vor allem politischen Situation, in der sich die venezolanischen Landsleute befinden, hat die Interministerielle Kommission f\u00fcr Asyl und Fl\u00fcchtlinge (CIAR) vorgeschlagen, B\u00fcrgern venezolanischer Staatsangeh\u00f6rigkeit, deren Antrag auf internationalen Schutz abgelehnt wurde, eine befristete Aufenthaltsgenehmigung aus humanit\u00e4ren Gr\u00fcnden f\u00fcr ein Jahr zu erteilen, die verl\u00e4ngert werden kann.<\/p>\n<h4><span style=\"font-size: 16px; letter-spacing: 0px;\">&nbsp;<\/span><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d897a35 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d897a35\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-extended\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5821f04 sc_inner_width_none sc_layouts_column_icons_position_left\" data-id=\"5821f04\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>FL\u00dcCHTLINGSSTATUS ODER SUBSIDI\u00c4RER SCHUTZ?
