{"id":23892,"date":"2025-11-13T15:41:31","date_gmt":"2025-11-13T15:41:31","guid":{"rendered":"https:\/\/martinezcaballeroabogados.com\/limitacio-de-la-indemnitzacio-per-acomiadament-improcedent-previst-a-lestatut-dels-treballadors\/"},"modified":"2025-11-27T09:41:16","modified_gmt":"2025-11-27T09:41:16","slug":"limitacio-de-la-indemnitzacio-per-acomiadament-improcedent-previst-a-lestatut-dels-treballadors","status":"publish","type":"post","link":"https:\/\/martinezcaballeroabogados.com\/ca\/limitacio-de-la-indemnitzacio-per-acomiadament-improcedent-previst-a-lestatut-dels-treballadors\/","title":{"rendered":"Limitaci\u00f3 de la indemnitzaci\u00f3 per acomiadament improcedent previst a l&#8217;estatut dels treballadors"},"content":{"rendered":"\n<p>El Suprem rebutja ampliar la indemnitzaci\u00f3 per acomiadament improcedent recollit a l&#8217;article 56.1 del nostre Estatut dels Treballadors: \u201cQuan l&#8217;acomiadament sigui declarat improcedent, l&#8217;empresari, en el termini de cinc dies des de la notificaci\u00f3 de la sent\u00e8ncia, podr\u00e0 optar entre la readmissi\u00f3 del treballador o l&#8217;abonament d&#8217;una indemnitzaci\u00f3 servei, prorratejant-se per mesos els per\u00edodes de temps inferiors a un any, fins a un m\u00e0xim de vint-i-quatre mensualitats.  <\/p>\n\n<p>El Tribunal Suprem, en sent\u00e8ncia dictada en Ple per la Sala Social el 16 de juliol de 2025 (STS 735\/2025, de 16 de juliol de 2025), ha confirmat que no cal recon\u00e8ixer una indemnitzaci\u00f3 per acomiadament superior a la prevista legalment quan aquest es declara improcedent. Llevat dels sup\u00f2sits expressament regulats pel legislador. La resoluci\u00f3 desestima el recurs de cassaci\u00f3 per a la unificaci\u00f3 de doctrina presentat per un treballador que reclamava una compensaci\u00f3 addicional pels perjudicis econ\u00f2mics derivats de l&#8217;acomiadament.    <\/p>\n\n<p><strong>La indemnitzaci\u00f3 per acomiadament es pot augmentar si hi ha danys addicionals?  <\/strong><\/p>\n\n<p>L&#8217;assumpte girava al voltant de si un jutge pot recon\u00e8ixer una indemnitzaci\u00f3 complement\u00e0ria a la taxada a l&#8217;article 56.1 de l&#8217;Estatut dels Treballadors, quan l&#8217;afectat considera que no cobreix adequadament el dany sofert.  <\/p>\n\n<p>El treballador invocava com a fonament el Conveni 158 de l&#8217;OIT, a l&#8217;article 10:  <\/p>\n\n<p>\u201cSi els organismes esmentats a l&#8217;article 8 del present Conveni arriben a la conclusi\u00f3 que la terminaci\u00f3 de la relaci\u00f3 de treball \u00e9s injustificada i si en virtut de la legislaci\u00f3 i la pr\u00e0ctica nacionals no estiguessin facultats o no consideressin possible, ateses les circumst\u00e0ncies, anul\u00b7lar la terminaci\u00f3 i eventualment ordenar o pagar el treballador de la readmissi\u00f3 del treballador adequada o una altra reparaci\u00f3 que es consideri apropiada\u201d.  <\/p>\n\n<p>I, l&#8217;article 24 de la Carta Social Europea Revisada:  <\/p>\n\n<p>Per garantir l&#8217;exercici efectiu del dret dels treballadors a protecci\u00f3 en cas d&#8217;acomiadament, les parts es comprometen a recon\u00e8ixer: El dret de tots els treballadors a no ser acomiadats sense que hi hagi raons v\u00e0lides per a aix\u00f2 relacionades amb les seves aptituds o la seva conducta, o basades en les necessitats de funcionament de l&#8217;empresa, de l&#8217;establiment o del servei; fi, les parts es comprometen a garantir que un treballador que estimi que se l&#8217;ha acomiadat sense una ra\u00f3 v\u00e0lida tingui dret a rec\u00f3rrer davant d&#8217;un organisme imparcial\u201d.  <\/p>\n\n<p>Aquestes s\u00f3n normes que exigeixen una compensaci\u00f3 adequada davant d&#8217;acomiadaments injustificats.  <\/p>\n\n<p>La sent\u00e8ncia aclareix que la indemnitzaci\u00f3 per acomiadament improcedent ja est\u00e0 determinada per l&#8217;ordenament jur\u00eddic espanyol. I que aquest compleix amb els est\u00e0ndards internacionals per les raons seg\u00fcents:   <\/p>\n\n<p>\u2022 El Conveni 158 de l&#8217;OIT i la Carta Social Europea no s\u00f3n aplicables directament i requereixen desenvolupament legislatiu intern.  <\/p>\n\n<p>\u2022 La normativa espanyola ja ofereix una resposta jur\u00eddica uniforme i predictible, que respecta el marge de configuraci\u00f3 que la Constituci\u00f3 atorga al legislador.  <\/p>\n\n<p>\u2022 Les recomanacions del Comit\u00e8 Europeu de Drets Socials o del Consell d&#8217;Europa no tenen cap valor vinculant. I, per tant, no poden justificar una modificaci\u00f3 judicial del sistema indemnitzatori vigent.   <\/p>\n\n<p>Per aix\u00f2, la indemnitzaci\u00f3 per acomiadament seria un sistema tancat excepte excepcions  <\/p>\n\n<p>El Suprem reafirma que la indemnitzaci\u00f3 per acomiadament improcedent queda limitada al que disposa l&#8217;article 56.1 de l&#8217;ET, tret que hi hagi violacions de drets fonamentals o altres casos expressament previstos per la llei.  <\/p>\n\n<p>Aquesta doctrina ja havia estat sostinguda en resolucions anteriors, com ara la STS 1350\/2024. 2 Per tant, els jutges es limiten a atorgar indemnitzacions addicionals per raons de l&#8217;acomiadament improcedent.   <\/p>\n\n<p>La Sala Social insisteix que el jutge no pot fixar una indemnitzaci\u00f3 per acomiadament diferent de la legal per aplicaci\u00f3 directa de normes internacionals, llevat que hi hagi una norma interna habilitant.  <\/p>\n\n<p>Aquesta sent\u00e8ncia consolida el marc de seguretat jur\u00eddica vigent i limita l&#8217;abast del control de convencionalitat a l&#8217;\u00e0mbit laboral, assegurant que els litigis sobre acomiadament es resolguin d&#8217;acord amb el que preveu la legislaci\u00f3 nacional.<br\/><br\/> Sheila Quiroz Sifuentes<br\/> <em>Advocada Experta en Dret Civil i Administratiu<\/em><br\/> <strong>Mart\u00ednez &amp; Caballero Advocats<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Suprem rebutja ampliar la indemnitzaci\u00f3 per acomiadament improcedent recollit a l&#8217;article 56.1 del nostre Estatut dels Treballadors: \u201cQuan l&#8217;acomiadament sigui declarat improcedent, l&#8217;empresari, en el termini de cinc dies des de la notificaci\u00f3 de la sent\u00e8ncia, podr\u00e0 optar entre la readmissi\u00f3 del treballador o l&#8217;abonament d&#8217;una indemnitzaci\u00f3 servei, prorratejant-se per mesos els per\u00edodes de temps inferiors a un any, fins a un m\u00e0xim de vint-i-quatre mensualitats.
