En aquest sentit, aquesta formalitat pr\u00e8via s&#8217;imposa a les empreses.   <\/p>\n\n<p>La primera formalitat \u00e9s que el treballador sigui notificat de manera escrita. Pel que fa als terminis, res no diu la jurisprud\u00e8ncia, per\u00f2 es pot aplicar un termini raonable d&#8217;entre 24 a 48 hores perqu\u00e8 el treballador pugui respondre a aquesta notificaci\u00f3 i pugui presentar les al\u00b7legacions oportunes sobre els fets que es descriuen a la mateixa carta.   <\/p>\n\n<p><strong>Les empreses poden ometre aquest tr\u00e0mit formal previ a l&#8217;acomiadament?  <\/strong><\/p>\n\n<p>Per regla general s&#8217;ha de complir amb aquesta formalitat, i aix\u00ed evitar que el comiat finalment notificat no sigui qualificat com a improcedent. Hi ha excepcions taxades i situacions excepcionals que podrien permetre l&#8217;omissi\u00f3 d&#8217;aquest tr\u00e0mit, per\u00f2 l&#8217;excepci\u00f3 no s&#8217;aplica autom\u00e0ticament.   <\/p>\n\n<p>L&#8217;empresa ha de justificar de forma expressa i detallada, a la carta d&#8217;acomiadament ia la documentaci\u00f3 interna, la concurr\u00e8ncia de la situaci\u00f3 excepcional que impedeix l&#8217;audi\u00e8ncia pr\u00e8via. Com, per exemple:   <\/p>\n\n<p>\u2022 Impossibilitat material de contactar amb la persona treballadora.  <\/p>\n\n<p>\u2022 Prescripci\u00f3 imminent de la manca.  <\/p>\n\n<p>\u2022 Conducta evidentment reconeguda i provada.  <\/p>\n\n<p>\u2022 Incidents greus que posin en perill la continu\u00eftat de l&#8217;empresa o la seguretat de persones i b\u00e9ns, on la demora per tr\u00e0mit d&#8217;audi\u00e8ncia pugui suposar danys irreparables (assetjament, agressi\u00f3 f\u00edsica, amenaces greus\u2026)  <\/p>\n\n<p>Aix\u00f2 no obstant, aquesta circumst\u00e0ncia s&#8217;ha d&#8217;indicar a la carta d&#8217;acomiadament, i manifestar el perqu\u00e8 de l&#8217;omissi\u00f3 a aquesta formalitat.  <\/p>\n\n<p>Durant el temps que se li atorga al treballador per donar resposta al tr\u00e0mit d&#8217;audi\u00e8ncia, l&#8217;empresa pot atorgar un perm\u00eds retribu\u00eft, mantenint el salari i la cotitzaci\u00f3, \u00e9s a dir, suspensi\u00f3 de feina, per\u00f2 no de sou.  <\/p>\n\n<p><strong>Baixes m\u00e8diques dels treballadors despr\u00e9s de la comunicaci\u00f3 -&gt;<\/strong> No existiria connexi\u00f3 directa entre la malaltia i l&#8217;acomiadament i no hi concorreria un indici suficient de discriminaci\u00f3 per ra\u00f3 de malaltia que pogu\u00e9s derivar en la nul\u00b7litat de l&#8217;acomiadament.  <\/p>\n\n<p>Aix\u00f2 no obstant, per evitar controv\u00e8rsies jur\u00eddiques sobre el moment de cada fet, es recomana que a l&#8217;escrit de comunicaci\u00f3 de l&#8217;inici del tr\u00e0mit d&#8217;audi\u00e8ncia consti amb claredat la data i l&#8217;hora de notificaci\u00f3.  <\/p>\n\n<p>A Martinez &amp; Caballero Advocats estarem encantats de poder assessorar-te!<br\/><br\/> Sheila Quiroz Sifuentes<br\/> <em>Advocada Experta en Dret Laboral<\/em><br\/> <strong>M&amp;C Advocats<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Arran de la STS de 18 de novembre del 2024, les empreses tenen l&#8217;obligaci\u00f3 d&#8217;oferir un tr\u00e0mit d&#8217;audi\u00e8ncia amb car\u00e0cter previ a l&#8217;acomiadament.
