Qu\u00e8 regula el Criteri de Gesti\u00f3 2\/2025?<\/strong><\/p>\n\n<p>El document proporciona instruccions detallades per gestionar els canvis d&#8217;ocupador o contracte a les autoritzacions per arrelament sociolaboral, assegurant que aquests s&#8217;executin correctament sense comprometre l&#8217;estatus legal del sol\u00b7licitant<a href=\"https:\/\/www.arc-legal.es\/nuevas-directrices-de-extranjeria-para-cambios-de-empleador-en-el-arraigo-sociolaboral\/?utm_source=chatgpt.com\"> <\/a><\/p>\n\n<p><strong>2. Principals novetats i regles clau<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Canvi lliure despr\u00e9s de tres mesos: Un cop transcorreguts tres mesos des de la concessi\u00f3 de l&#8217;autoritzaci\u00f3, l&#8217;estranger pot canviar d&#8217;ocupador sense necessitat de justificar-ne el motiu ni comunicar-ho a Estrangeria<br\/><\/li>\n\n\n\n<li>Canvi abans dels tres mesos per causa justificada: En situacions com que la sol\u00b7licitud encara estigui en tr\u00e0mit, que s&#8217;hagi concedit l&#8217;autoritzaci\u00f3 per\u00f2 no s&#8217;hagi produ\u00eft l&#8217;alta a la Seguretat Social, o que hi hagi una alta i baixa immediata, el canvi s\u00ed que est\u00e0 perm\u00e8s. Per\u00f2 cal comunicar-ho a l&#8217;Oficina d&#8217;Estrangeria juntament amb el nou contracte <br\/><\/li>\n\n\n\n<li>Terminis per comunicar el canvi:<br>\n<ul class=\"wp-block-list\">\n<li>General: dos mesos des que es coneix la necessitat del canvi.<br\/><\/li>\n\n\n\n<li>Si no hi ha alta a la Seguretat Social despr\u00e9s de la concessi\u00f3: termini redu\u00eft a un mes<br\/><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Requisits del nou contracte: Ha de complir els requisits m\u00ednims del RLOEX: almenys part proporcional del Salari M\u00ednim Interprofessional, jornada m\u00ednima de 20 hores setmanals (es pot assolir amb un o diversos contractes)<br\/><\/li>\n\n\n\n<li>Aplicable tamb\u00e9 durant recursos de reposici\u00f3: Si el canvi ocorre mentre es tramita un recurs de reposici\u00f3, el sol\u00b7licitant t\u00e9 dos mesos per comunicar-ho, i la seva autoritzaci\u00f3 es mant\u00e9 sempre que es doni d&#8217;alta a la Seguretat Social el mes seg\u00fcent<br\/><\/li>\n\n\n\n<li>Vinculaci\u00f3 amb arrelament social previ: El criteri s&#8217;est\u00e9n tamb\u00e9 als qui van obtenir resid\u00e8ncia per arrelament social segons la normativa anterior (RD 557\/2011), sempre respectant els requisits vigents d&#8217;aquell temps<br\/><\/li>\n<\/ul>\n\n<p><strong>3. Per qu\u00e8 \u00e9s important aquest criteri?<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Major seguretat jur\u00eddica: Els sol\u00b7licitants poden canviar de feina sense por de perdre la seva autoritzaci\u00f3.<br\/><\/li>\n\n\n\n<li>Flexibilitat davant d&#8217;imprevistos: Protegeix els qui enfronten situacions laborals inesperades que impedeixin continuar amb l&#8217;ocupador original.<br\/><\/li>\n\n\n\n<li>Claredat per a entitats oficials: Evita interpretacions diferents entre oficines d&#8217;estrangeria.<br\/><\/li>\n\n\n\n<li>Estabilitat durant processos administratius: Garanteix l&#8217;estatus legal fins i tot durant els recursos administratius.<br\/><\/li>\n<\/ul>\n\n<p><strong>4. Impacte pr\u00e0ctic per a sol\u00b7licitants i assessors<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Sol\u00b7licitants: Ara saben que poden canviar d&#8217;ocupador si la situaci\u00f3 ho requereix, amb terminis clars i sense risc de perdre l&#8217;autoritzaci\u00f3.<br\/><\/li>\n\n\n\n<li>Assessors i ONG: Compten amb una guia clara per orientar els qui necessiten aquests canvis.<br\/><\/li>\n\n\n\n<li>Administraci\u00f3: Disposa de criteris coherents per gestionar qualsevol sol\u00b7licitud de canvi de contracte sense disparitat entre regions.<br\/><\/li>\n<\/ul>\n\n<p><strong>5.
