Cal diferenciar entre <\/p>\n\n<p><strong>ACCIDENT DE TREBALL:<\/strong><\/p>\n\n<p>La definici\u00f3 la recull l&#8217;article 156 LGSS. \u00c9s accident laboral <strong>tota lesi\u00f3 corporal que el treballador pateixi en ocasi\u00f3 o per conseq\u00fc\u00e8ncia de la feina.<\/strong> <\/p>\n\n<p>Com es despr\u00e8n de la definici\u00f3, l&#8217;accident de treball es pot produir <strong>tant com a conseq\u00fc\u00e8ncia de la feina, com en ocasi\u00f3 de la feina.<\/strong><\/p>\n\n<p>Aix\u00ed, s&#8217;inclouen en el concepte els <a href=\"https:\/\/juantorroba.es\/blog\/indemnizacion-accidente-trafico-in-itinere\/\">accidents produ\u00efts <em>in itinere<\/em><\/a> , \u00e9s a dir, en el trajecte realitzat per anar i tornar de la feina i tamb\u00e9 els produ\u00efts en qualsevol altra situaci\u00f3 en qu\u00e8 es trobe el treballador per motiu de la feina (els actes de representaci\u00f3 dels treballadors, les malalties provocades per la feina, etc.).<\/p>\n\n<p><strong>Exemples<\/strong> d&#8217;accident de treball s\u00f3n ensopegar amb un cable a l&#8217;oficina i patir lesions a la caiguda, caure d&#8217;una bastida quan durant els treballs de construcci\u00f3, patir talls en manejar maquin\u00e0ria de l&#8217;empresa, etc.<\/p>\n\n<p><strong>MALALTIA COM\u00da:<\/strong><\/p>\n\n<p>  Es considera accident no laboral el que, d&#8217;acord amb all\u00f2 que estableix l&#8217;article 156, no tingui el car\u00e0cter d&#8217;accident de treball.<\/p>\n\n<p>Es considera que constitueixen malaltia comuna les alteracions de la salut que no tinguin la condici\u00f3 d&#8217;accidents de treball ni de malalties professionals, d&#8217;acord amb el que disposen, respectivament, els apartats 2.e), f) ig) de l&#8217;article 156 i l&#8217;article 157.  <\/p>\n\n<p>Quins beneficis podeu obtenir en cas d&#8217;una incapacitat temporal, ja sigui per accident de treball o malaltia comuna?<\/p>\n\n<p><strong>Tindr\u00e0s dret a sol\u00b7licitar el subsidi per incapacitat temporal<\/strong><\/p>\n\n<p>Per poder cobrar el subsidi per incapacitat temporal, en tots dos casos, <strong>el treballador ha d&#8217;estar afiliat i en alta o en <a href=\"https:\/\/josepmariamerino.com\/es\/situacion-asimilada-alta\/\">situaci\u00f3 assimilada a l&#8217;alta<\/a> a la Seguretat Social.<\/strong> <\/p>\n\n<ul class=\"wp-block-list\">\n<li>No obstant aix\u00f2, <strong><a href=\"https:\/\/josepmariamerino.com\/es\/incapacidad-permanente-enfermedad-comun\/\">si la incapacitat es deu a una malaltia comuna<\/a><\/strong> , s&#8217;exigeix un per\u00edode previ de cotitzaci\u00f3 <strong>de 180 dies en els 5 anys anteriors<\/strong> .<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/josepmariamerino.com\/es\/incapacidad-permanente-total-accidente-laboral\/\">Per a l&#8217;accident de treball<\/a><\/strong> no s&#8217;exigeix que s&#8217;hagi cotitzat pr\u00e8viament, de manera que es pot apreciar aquesta causa d&#8217;incapacitat des del primer dia de feina d&#8217;una persona.<\/li>\n<\/ul>\n\n<p>Pel que fa als <strong>possibles beneficiaris del subsidi<\/strong> , encara que la llei nom\u00e9s parla de la feina per compte d&#8217;altri com a \u00e0mbit en qu\u00e8 es pot ocasionar un accident de treball, els <strong>treballadors subjectes al r\u00e8gim especial de treballadors aut\u00f2noms (RETA)<\/strong> tamb\u00e9 podran accedir al subsidi tant per accident laboral com per malaltia comuna.<\/p>\n\n<p><strong>Com opera aquest subsidi per Incapacitat Temporal?<\/strong><\/p>\n\n<p>En aquest aspecte, les difer\u00e8ncies entre ambdues conting\u00e8ncies es troben en el moment d&#8217; <strong>inici de cobrament del subsidi i en l&#8217;import d&#8217;aquest<\/strong> ( <a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2015-11724&amp;p=20230629&amp;tn=1#a173\">art. 173 de la LGSS<\/a> ):<\/p>\n\n<ul class=\"wp-block-list\">\n<li>En cas de <strong>malaltia comuna<\/strong> , es cobra el 60% de la base reguladora des del 4t dia de baixa fins al dia 20, ambd\u00f3s inclosos, ia partir del dia 21 es cobra el 75%.<\/li>\n\n\n\n<li>En cas d&#8217; <strong>accident de treball<\/strong> , es cobra el 75% de la base reguladora des del mateix dia seg\u00fcent al de la baixa a la feina, que se suposa que ser\u00e0 el dia en qu\u00e8 es produeix l&#8217;accident. El dia de l&#8217;accident l&#8217;empresari pagar\u00e0 \u00edntegre com a dia de salari. <\/li>\n<\/ul>\n\n<p>Aix\u00f2 no obstant, en aquest aspecte, caldr\u00e0 estar al que estableixi el conveni col\u00b7lectiu, que pot millorar els drets del treballador (per exemple, reconeixent que cobri el 100% del seu salari des del primer dia de baixa, a trav\u00e9s d&#8217;un complement d&#8217;incapacitat que haur\u00e0 de pagar l&#8217;empresa).<\/p>\n\n<p><strong>qui paga el subsidi per incapacitat temporal en cas daccident laboral i malaltia comuna?<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>En el cas dels treballadors per compte ali\u00e8:<\/strong>\n<ul class=\"wp-block-list\">\n<li>En general, el pagament \u00e9s a c\u00e0rrec de l&#8217;Institut Nacional de la Seguretat Social (INSS), la m\u00fatua col\u00b7laboradora amb la Seguretat Social o l&#8217;Institut Social de la Marina (ISM), segons el cas.<\/li>\n\n\n\n<li>Per a la malaltia comuna, el pagament entre els dies 4t i 15\u00e8 \u00e9s a c\u00e0rrec de l&#8217;empresari, per\u00f2 a partir del 16 pagar\u00e0 l&#8217;INSS, la m\u00fatua o l&#8217;empresa autoritzada que hagi triat l&#8217;empresari (art. 173 de la LGSS).<\/li>\n\n\n\n<li>Per a laccident de treball, la responsable del pagament ser\u00e0 la m\u00fatua col\u00b7laboradora amb la Seguretat Social que hagi triat lempresa.<\/li>\n\n\n\n<li>En qualsevol cas, el pagament el realitzar\u00e0 l&#8217;empresari, com <a href=\"https:\/\/josepmariamerino.com\/es\/pago-delegado-y-directo-incapacidad-temporal\/\">a pagament delegat<\/a> i amb la mateixa periodicitat que els salaris, encara que hi ha casos excepcionals en qu\u00e8 el pagament es realitza directament per l&#8217;INSS, l&#8217;ISM o la m\u00fatua col\u00b7laboradora (pagament directe de prestacions, que l&#8217;afectat ha de sol\u00b7licitar en qualsevol cas)<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Per als treballadors per compte propi.<\/strong>  El pagament el far\u00e0 directament la M\u00fatua Col\u00b7laboradora o l&#8217;entitat gestora competent.<\/li>\n<\/ul>\n\n<p><strong>Quan dura el subsidi per incapacitat temporal en cas d&#8217;accident laboral o malaltia comuna?<\/strong><\/p>\n\n<p>Tant en cas de malaltia com d&#8217;accident, la durada m\u00e0xima del subsidi est\u00e0 legalment estipulada en <strong>365 dies, prorrogables<\/strong> per un altre per\u00edode de 180 dies m\u00e9s si durant aquest transcurs de temps es preveu que hi pugui haver curaci\u00f3 (art. 169.1.a de la LGSS).<\/p>\n\n<p><strong>Quan el subsidi s&#8217;extingeix per incapacitat temporal?<\/strong><\/p>\n\n<p>En cas d&#8217;accident de treball o malaltia comuna, <strong>el subsidi s&#8217;extingeix pel <a href=\"https:\/\/josepmariamerino.com\/es\/agotado-plazo-incapacidad-temporal\/\">transcurs del termini m\u00e0xim<\/a> establert legalment, o per rebre l&#8217;alta m\u00e8dica<\/strong> (tant si se&#8217;n deriva una declaraci\u00f3 d&#8217;incapacitat permanent com si no), fet que pot passar en qualsevol moment al llarg del per\u00edode durant el qual s&#8217;est\u00e0 de baixa m\u00e8dica.<\/p>\n\n<p>Tamb\u00e9 \u00e9s possible que s&#8217;extingeixi el subsidi <strong>perqu\u00e8 el treballador sol\u00b7liciti l&#8217;alta m\u00e8dica volunt\u00e0riament<\/strong> , perqu\u00e8 <a href=\"https:\/\/josepmariamerino.com\/es\/pasar-incapacidad-permanente-a-jubilacion\/\">passi a ser pensionista per jubilaci\u00f3<\/a> i, \u00f2bviament, tamb\u00e9 per mort.<\/p>\n\n<p>Hi ha la possibilitat que el treballador <strong>no es presenti als reconeixements m\u00e8dics<\/strong> que estableixin els professionals de la Seguretat Social, cosa que comporta igualment l&#8217;extinci\u00f3 del subsidi.<\/p>\n\n<p><strong>COM PROCEDIR SI PATIM UN ACCIDENT O PATIM UNA MALALTIA COM\u00da?<\/strong><\/p>\n\n<p><strong>En cas d&#8217;accident laboral -&gt;<\/strong> Hem de sol\u00b7licitar a l&#8217;empresa un volant d&#8217;assist\u00e8ncia per a la M\u00fatua de l&#8217;empresa<\/p>\n\n<p>Si l&#8217;accident \u00e9s de gran gravetat, es pot personar la policia i acudir al centre de treball la Inspecci\u00f3 de Treball mateixa, i puguin iniciar un procediment de rec\u00e0rrec de prestacions contra l&#8217;empresa si detecten que l&#8217;accident de treball es va produir per no complir l&#8217;empresa amb les obligacions de seguretat i prevenci\u00f3 de riscos laborals.<\/p>\n\n<p><strong>En cas de malaltia comuna -&gt;<\/strong> Ens dirigim al nostre centre de salut i procediran a emetre&#8217;ns el comunicat de baixa m\u00e8dica.<\/p>\n\n<p>Ara ja no \u00e9s obligatori que els treballadors envi\u00efn els comunicats de baixa m\u00e8dica a les empreses, \u00fanicament hauran d&#8217;informar les empreses que es troben de baixa m\u00e8dica, i el mateix en cas que ja els sigui comunicada l&#8217;alta m\u00e8dica.<\/p>\n\n<p>Hi ha un fitxer FIE de la seguretat social on informen si els treballadors de l&#8217;empresa han registrat baixes m\u00e8diques o altes m\u00e8diques, per\u00f2 no \u00e9s un mitj\u00e0 immediat, per aix\u00f2 es recomana als treballadors que comuniquin a les empreses en cas d&#8217;iniciar un per\u00edode d&#8217;incapacitat temporal.<\/p>\n\n<p><strong>Qui ens paga i quins imports?<\/strong><\/p>\n\n<p>Com ho vaig indicar anteriorment que en darrer lloc pagar\u00e0 sempre l&#8217;empresa com a pagament delegat.<\/p>\n\n<p>Pel que fa als imports generals indicats, a m\u00e9s, hem de revisar cada conveni de treball per veure si tenim un benefici de Complement d&#8217;Incapacitat
