Perqu\u00e8 sigui qualificat com a improcedent, l&#8217;acomiadament ha de ser impugnat davant de l&#8217;ordre social.<\/div>\n<div> <\/div>\n<div><strong>En quins sup\u00f2sits entenem que \u00e9s un acomiadament improcedent?<\/strong><\/div>\n<div> <\/div>\n<ul>\n<li>L&#8217;empresari no acredita, a la carta d&#8217;acomiadament, les causes d&#8217;aquest.<\/li>\n<li>L&#8217;empresari no compleix les formalitats requerides per la llei o pels convenis col\u00b7lectius.<\/li>\n<li>En cas que es tracti d\u201fun acomiadament a un treballador afiliat a un sindicat, l\u201fempresari omet el tr\u00e0mit de l\u201faudi\u00e8ncia als delegats sindicals o el tr\u00e0mit de l\u201fexpedient contradictori en el cas d\u201facomiadament d\u201fun representant dels treballadors.<\/li>\n<\/ul>\n<div><strong>Si l&#8217;acomiadament es considera improcedent Qu\u00e8 passar\u00e0 a continuaci\u00f3? <\/strong><\/div>\n<div> <\/div>\n<div>Si es declara la improced\u00e8ncia de l&#8217;acomiadament, la sent\u00e8ncia condemnar\u00e0 l&#8217;empresa a optar en el termini de cinc dies des de la notificaci\u00f3 d&#8217;aquesta a:<\/div>\n<div> <\/div>\n<ul>\n<li>Readmetre al treballador abonant-li aquells salaris que va deixar de percebre des de la data de l&#8217;acomiadament considerat improcedent.<\/li>\n<li>Indemnitzar el treballador atenent el c\u00f2mput dels dies de salari per any treballat.<\/li>\n<\/ul>\n<div> <\/div>\n<div>La titularitat de l&#8217;opci\u00f3 recau, amb car\u00e0cter general, a l&#8217;Empresari, encara que tamb\u00e9 pot correspondre al treballador acomiadat quan \u00e9s un representant unitari o sindical dels treballadors.<\/div>\n<div> <\/div>\n<div><strong>Qu\u00e8 aconsellem des de Mart\u00ednez Caballero Advocats? <\/strong><\/div>\n<div> <\/div>\n<ul>\n<li>Si com a empleat t&#8217;han acomiadat i consideres que no hi ha motius que ho justifiquin, en el moment que hagis de signar la comunicaci\u00f3 de l&#8217;acomiadament, cal que al costat de la signatura aparegui un \u201cno conforme\u201d.
